Open Data Terms of Use Government 1.0

The use or reuse of data must comply with the terms and conditions as outlined below.

1. Use of data under these terms

1. The data owner grants permission to use the data without any charge.

2. Users may do the following:

1. Copy, publish, distribute, and transfer the data;
2. Adapt the data;
3. Use the data for commercial and non-commercial purposes; and
4. Combine the data with other data or incorporate it into products or applications.

3. When performing any of the actions mentioned in section 2, users MUST:

1. Acknowledge the data source in the product or application according to the attribution determined by the data owner;
2. Provide a link to these Terms of Use; and
3. If the data owner does not provide an intellectual property attribution statement, users must use the following statement:

"Data and information are subject to the Open Data Terms of Use Government Malaysia 1.0"

4. EXCLUSIONS
These Terms of Use do not grant any rights to:

1. Personal data;
2. The name, coat of arms, logo, or any official symbols of the data owner;
3. Logos of public sector organizations or departments;
4. Royal emblems and military insignia;
5. Third-party rights over which the data owner has no authority;
6. Any intellectual property rights including patents, trademarks, and design rights; and
7. Identity documents such as the Malaysian Passport or MyKad.

5. NO WARRANTIES

1. The data is provided as-is by the data owner. The data owner disclaims any representations, warranties, obligations, and liabilities in relation to the data; and
2. The data owner is not responsible for any errors or data loss. The data owner is also not liable for any loss, injury, or damage resulting from the use of the data. The data owner makes no guarantee that the data will be available continuously.

6. LAW

1. These Terms of Use are governed by the laws under the jurisdiction, and the data owner remains the primary owner of the data.
